Japan Fair Trade Commission

The Japan Fair Trade Commission (JFTC) today issued the warning to the 2 petroleum products retailers (BARON RARK Co.,Ltd., Costco Wholesale Japan,Ltd., hereinafter referred to as the “two companies”) that operate gas stations in Tokoname city, Aichi Prefecture.

In this case, two companies were likely to be in violation of prohibition of Article 19 (Unjust Low Price [Article 2, Paragraph 9, Item 3]) of Antimonopoly Act.

Two companies were supplying regular gasoline at a low price continuously for ten days, from November 18 to 27, 2015, which was excessively below the costs required for supply, thereby being likely to cause difficulties to the business activities of other petroleum products retailers in the surrounding area of their gas stations.
