Consent decision issued to Taihei Building Service Corporation on bid-rigging for building cleaning works

The JFTC, on 11 June 2003, decided to initiate hearing procedures against Taihei Building Service Corporation and has been having examiners conduct the procedures. The JFTC received a request for consent decision and plans for specific measures from Taihei Building Service Corporation on 25 July 2003 in accordance with 53(3) of Antimonopoly Act and Section 81 of Rules concerning Investigation and Hearing by the JFTC.

As a result of consideration, the JFTC approved of this measure and issued a resulting decision to the company on 7 August 2003 in accordance with Section 53(3) of Antimonopoly Act.

1. (1) Fact of violation

i ) The respondent and other 21 companies, since 1 March 1998 at the latest (3 companies participated later), had been substantially restricting competition in the trading field relating to designated competitive bids for building cleaning works called by public offices of Yamaguchi district contrary to the public interest by colluding to prearrange the winner of the bids.

ii ) The respondent and other 13 companies, since 1 March 1998 at the latest (2 companies participated later), had been substantially restricting competition in the trading field relating to designated competitive bids for building cleaning works called by public offices of Shimonoseki City district contrary to the public interest by colluding to prearrange the winner of the bids.

Section 3 (unreasonable restraint of trade) of the Antimonopoly Act

(3)Outline of measures

i)The respondent shall confirm that it has stopped the acts of above (1).

ii)The respondent shall notify above governments and municipal offices of measures taken according to the above i) and of free and independent sales activity in the future.

iii) The respondent shall not act the same kind of acts as above in the future.
