Japan Fair Trade Commission
As for bids called by City of Chiba and Chiba City Urban Development Corporation (hereinafter “City of Chiba etc.”), the Japan Fair Trade Commission(hereinafter, “JFTC”) ordered 81 participants in tendering for construction works to pay surcharge in accordance with Section 48-2(1) of the Antimonopoly Act.
1. Violation related to surcharge (recommendation 30 Oct 2002, decision 4 Dec 2002 (decision for one constructor 8 Jan 2003))
The following companies conspired to rig bids by predetermining a winning bidder to enter into contracts let through competitive bidding. These acts infringed Section 3 of the Antimonopoly Act.
(1)122 constructors of civil engineering
Parties Concerned: Ito Komuten K.K. and 121 other corporations.
The Bidding Process: designated competitive bidding process etc.
(2)100 constructors of paving roads
Parties Concerned: Onagi Gumi K. K. and 99 other corporations.
