The JFTC issued Cease and Desist Order to Okayama Prefecture Kita Ready-mixed Concrete Association

The Japan Fair Trade Commission (JFTC) has today issued the cease and desist order to Okayama Prefecture Kita Ready-mixed Concrete Association (hereinafter referred to as the “Association”), finding that the Association prevents customers from purchasing ready-mixed concrete from non-member of the Association, by means of announcing to customers that the price of ready-mixed concrete will be changed to catalog price, which is higher than usual one and only cash payment will be accepted if customers purchase it from non-member.

Prior to the issuance of the cease and desist order, the JFTC had notified the Association of the contents of the proposed order and provided it with an opportunity to submit its opinion and evidence to the JFTC. The order has been issued after the JFTC took into consideration the opinion and the evidence so submitted. A recipient dissatisfied with the order may request, within sixty days of the service of the transcript of the order, the JFTC to initiate the hearing procedures regarding the order.
