The JFTC Issued Cease and Desist Orders and Surcharge Payment Orders to Two Manufacturers of Modified Asphalt for Paving

The Japan Fair Trade Commission (JFTC) today issued cease and desist orders and surcharge payment orders to two manufacturers, Nichireki Co., Ltd. and Nissin Kasei Co., Ltd., of Modified Asphalt for Paving. These manufacturers violated the prohibition of the Article 3 of the Antimonopoly Act (AMA). The total amount of the surcharge to be paid is about 3,140 million yen.
 
JFTC found that the above two manufacturers and Toa Road Corporation (hereinafter “3 companies”) substantially restrained competition in the field of sales of Modified Asphalt for Paving by agreeing their markup, etc.
 
JFTC also today issued a caution to the other 5 companies which discussed transaction with 3 companies in some areas are likely to be in violation of prohibition of the Article 3 of the AMA.
 
*“Modified Asphalt for Paving” means the asphalt made of Straight Asphalt with its characteristics has been changed with modifier such as SBS (Styrene-butadiene-styrene block copolymer) as a material of Asphalt Mixture, which is used for paving roads, etc.
