The JFTC issued Cease and Desist Order to Abashiri Concrete Products Association and Surcharge Payment Orders to members of the Association

The Japan Fair Trade Commission (JFTC) today issued cease and desist order to Abashiri Concrete Products Association (hereinafter referred to as the “Association”) and surcharge payment orders to members of the Association, finding that they substantially restrained competition in the field of concrete secondary products (Note), by means of (1) designating a seller for each user and (2) determining to limit the discount rate to 10 %. The total amount of the surcharge is 5,859 million yen.

Before issuing the cease and desist order and the surcharge payment orders, the JFTC had notified the Association and members of the Association of the contents of the proposed orders and provided them with opportunities to present their opinion and submit evidence. The JFTC issued the orders taking the opinion and the evidence submitted into consideration. A recipient dissatisfied with the JFTC orders may request, within sixty days of the date on which the transcript of the orders were served, the JFTC to initiate hearing procedures regarding the orders.

(Note) “Concrete secondary products” mean the products made of the fresh concrete poured into a mold and hardened.
