The Japan Fair Trade Commission Concluded Memorandum on Cooperation with the Ministry of Commerce of the People’s Republic of China

The Japan Fair Trade Commission (hereinafter, “JFTC”), on 11th of April, 2016 in Tokyo, concluded Memorandum on Cooperation with the Ministry of Commerce (hereinafter, “MOFCOM”), which is one of the competition authorities of the People’s Republic of China. The signers and the outline of this Memorandum are as follows:

1. Signers

The JFTC: Mr. Kazuyuki Sugimoto, Chairman
The MOFCOM: Mr. Tong Daochi, Assistant Minister

2. Outline

(1) Purpose of Cooperation

The purpose of this Memorandum is to enhance the partnership of the JFTC and the MOFCOM (hereinafter, “the Sides”) by providing a sound mechanism for their communication and cooperation in the fields of competition law and policy as well as enforcement.

(2) Communication

(a) The Sides will exchange information regarding developments in their respective competition legislation, enforcement and policy, etc.
(b) The Sides will exchange information with each other on individual cases that the Sides concurrently review, as agreed by the Sides.

(3) Annual Consultation

The Sides will meet at least once a year to exchange views.

(4) Technical Cooperation

The Sides recognize that it is in their common interest to work together in technical cooperation activities with a view to strengthening competition policy and law enforcement in both countries.
