JFTC hosts ICN Unilateral Conduct Workshop in Tokyo

The Japan Fair Trade Commission (JFTC) will host the International Competition Network (ICN(note)) Unilateral Conduct Workshop 2023 in Tokyo as follows.

ICN workshops are fora for officials of competition authorities and Non-Governmental Advisors (NGAs) such as lawyers and academics to share their expertise and experience with one another. ICN Unilateral Conduct Workshops have been held about once every year or two since 2009.

The workshop will have about 340 officials and NGAs from over 50 countries and regions as participants, and they will discuss a wide range of topics on unilateral conducts, including issues in the digital field, developments of policies and challenges in investigative methods under the theme of “Developments and Challenges of Competition Policy and Enforcement in the Current Unilateral Conduct Area.”

“Developments and Challenges of Competition Policy and Enforcement in the Current Unilateral Conduct Area”

(Note: Overview of the ICN)
The ICN is an international network which was established in October 2001. As of January 2023, the ICN consists of 143 competition authorities from 132 countries and regions. The purpose of the ICN is to promote procedural and substantive convergence in competition laws. In addition to the competition authorities, experts from international organizations and NGAs also take part in ICN’s activities.

9:30 - 10:45 Plenary Session 1: UCWG Project Report - the Analysis of Theories of Harm and Design of Remedies Concerning Unilateral Conduct with Dominance/Substantial Market Power in Digital Markets
11:15 - 12:15 Breakout Sessions 1-3 (discuss topics related to Plenary Session 1)
13:45 - 15:00 Plenary Session 2: Recent competition policy initiatives, legislative developments and challenges ahead in the unilateral conduct area
15:30 - 16:30 Breakout Sessions 4-6 (discuss topics related to Plenary Session 2)

13:30 - 14:45 Plenary Session 4: Cooperation and coordination with other policy authorities in the unilateral conduct sphere (e.g. Data Protection authorities, Consumer Protection authorities)
15:15 - 16:30 Plenary Session 5: Current and future issues for competition enforcers
16:30 - 16:45 Closing Session

5. Publication of the workshop
An ICN Unilateral Conduct Workshop is usually open only to officials from ICN member agencies and NGAs who have registered in advance to attend it. However, the sessions of the workshop highlighted in gray on the table above will be streamed at the official YouTube account of the JFTC at https://www.youtube.com/c/JFTCchannel in the near future so that other stakeholders can follow the discussions at the workshop.

Those sessions highlighted above are also open to the press for covering the sessions in person. Request for press pass should be submitted to ICN Unilateral Conduct Workshop Team at the International Affairs Division of the JFTC via email at icnucworkshop2023@jftc.go.jp by 12:00 p.m. on Friday, March 3rd, 2023 (Japan Standard Time).
