Request for Public Comments on the Draft of ‘Guidelines Concerning the Activities of Enterprises, etc. Toward the Realization of a Green Society under the Antimonopoly Act’

In ‘Plan for Global Warming Countermeasures’ (Cabinet decision, October 22, 2021), Japan declared goals of reducing greenhouse gas emission as of 2030 and 2050.
For achieving those goals, it is needed to build the society which combines reduction of environmental impact and economic growth, that is, ‘Green Society.’
It is expected that business initiatives toward Green Society will become active and concrete in the near future. The JFTC decides to clarify the application of the Antimonopoly Act to those initiatives in order to prevent anticompetitive conduct which deters realization of Green Society, and to raise transparency and predictability of the application and enforcement of the Act for business activities toward Green Society.
Against the above background, from October to December 2022 the JFTC held the ‘Study Group on Guidelines for Business Initiatives toward Green Society,’ hosted by the Director General of the Economic Affairs Bureau of the JFTC, so as to consider the guidelines based on expertise of invited experts and the current state of Japan. Then, the JFTC compiled the Draft of ‘Guidelines Concerning the Activities of Enterprises, etc. Toward the Realization of a Green Society under the Antimonopoly Act’ taking into account the opinions of invited experts in the Study Group, etc.

1. How to obtain related materials
Related materials are available at the followings:
a. The e-Gov page of e-Government;
b. The website of the JFTC; or
c. The Head Office (Tokyo), Local Offices (Sapporo, Sendai, Nagoya, Osaka and Fukuoka) and Branches (Hiroshima and Takamatsu) of the JFTC and the Fair Trade Office of the Okinawa General Bureau, General Affairs Division, Cabinet Office (Naha).
 
2. How to submit comments
Please submit your comments in Japanese by either of the following methods, identifying your name, address, and contact information (telephone number or e-mail address). If you submit your comments as a corporation or an association, please identify the location of its main office, the name of a corporation or an association, and the name of a liaison person. Submitting comments by phone cannot be accepted.
