On March 31, 2023, the Japan Fair Trade Commission (hereinafter referred to as the ‘JFTC’) compiled the ‘Guidelines Concerning the Activities of Enterprises, etc. Toward the Realization of a Green Society under the Antimonopoly Act’ (hereinafter referred to as the ‘Green Guidelines’) for the purpose of encouraging the efforts of enterprises and trade associations (hereinafter referred to as ‘enterprises, etc.’) for the realization of carbon neutrality. After the compilation of the Green Guidelines, the JFTC has received consultations about concrete efforts and has explained the contents of the Green Guidelines to enterprises, etc.
With regard to the Green Guidelines, the JFTC has published its policy to keep reviewing them continuously. Now, based on the concrete consultation cases and the results of exchange of views with enterprises, etc., the JFTC decided to encourage the efforts of enterprises, etc. toward the realization of Green Society by revising the Green Guidelines for the further clarification of application of the Antimonopoly Act to joint abolishment, joint procurement, etc. In this regard, the Cabinet of Japan decided the ‘Basic Policy on Economic and Fiscal Management and Reform 2023’, the ‘Grand Design and Action Plan for a New Form of Capitalism 2023 Revised Version’ in June 2023, and the ‘Comprehensive Economic Measures for Completely Break Free from Deflation’ in November 2023, and the further clarification of the Green Guidelines is described in those policies of the whole Government.
Based on those backgrounds, the JFTC invites comments from the stakeholders on the draft of revised ‘Guidelines Concerning the Activities of Enterprises, etc. Toward the Realization of a Green Society under the Antimonopoly Act’ as follows.
1. How to obtain related materials
Related materials are available at the followings:
a. The e-Gov page of e-Government;
b. The website of the JFTC; or
c. The Head Office (Tokyo), Local Offices (Sapporo, Sendai, Nagoya, Osaka and Fukuoka) and Branches (Hiroshima and Takamatsu) of the JFTC and the Fair Trade Division, General Affairs Department, Okinawa General Bureau, Cabinet Office (Naha).
2. How to submit comments
Please submit your comments in Japanese by either of the following methods, identifying your name, address, and contact information (telephone number or e-mail address). If you submit as a corporation or an association, please identify the location of its main office, the name of a corporation or an association, and the name of a liaison person. Submitting a comment by phone cannot be accepted.
