JFTC issues a recommendation to participants in bids for paving works let by Kyoto-city.

The JFTC, following an investigation into participants in bids for paving work contracts called by Kyoto-city, issued today a recommendation to 12 construction companies in violation of section 3[unreasonable restraint of trade] of the Antimonopoly Act.

 1 Recommendation

 i) Outline of violation
13 paving constructors (including 1 company which is not a recipient of recommendation because of bankrupcy), since April 2000 at the latest,have been carrying out bid-riggings to prevent a price decline by designating the winner of bids for paving works (budget: more than 50 millon yen) by Kyoto-city, thereby substantially restricting competition contrary to the public interests.

 iii) Elimination measures

Confirmation of cessation of the above conducts, etc.

 iii) The due date for acceptance of reccomendation:

5 June 2003 Recommendation/decision if accepted, or otherwise, proceed to initiate hearings.
2 Warning

JFTC also issued a warning against paving constructors for possible infringement of Section 3 of the Act by suspected bid-riggings in bids fot paving works let by Kyoto-city in FY2000 and FY2001.
