(Market Study on Contracts between Performers and Agencies in the Fields of Music and Broadcast Programming)

     Today, I would like to talk about the JFTC’s ongoing market study which is for ensuring fair transaction for creators and the establishment of an information form for anybody to provide information as the part of the survey.

     The JFTC has been promoting various initiatives to enhance fair and free competition in the human resources and entertainment fields. As explained by Chairman Furuya at the Council of New Form of Capitalism Realization held on Wednesday the 17th of last week, the JFTC is proceeding the market study, starting this month, for improving the transactions to support creators, with the aim of creating a trading environment that maximizes the creativity of individual creators.

     First, we have started a survey on the actual conditions in the field of music and broadcasting programs this month. The survey is intended to ascertain the status of contracts between performers, who are called such as artists, actors and talents, and entertainment agencies & production companies they belonged. The survey will also examine the relationship between performers, entertainment agencies & production companies, business associations, record companies and broadcasters.

     Following the survey targeting the music and broadcast programs fields, we plan to start another survey from the beginning of next year for the fields of movies and animations to ascertain the actual conditions and environment of creators’ business transactions.

     In these fields, there are many concerns about the exploitation of creators’ talents by businesses that have gained a certain position in the industry, and it is an urgent issue to ensure a trading environment that allows creators to maximize their creativity. We would like to ask all parties concerned to cooperate with our survey.

     We plan to compile and publish the results of the survey in the field of music and broadcast programs by the end of this year. Based on the results of the survey, we intend to promptly begin formulating guidelines that will contribute to the improvement of the transactions to support creators and clearly indicate specific point of view under the Antimonopoly Act and competition policy.

     We set up a dedicated information form on the JFTC’s website, last week on Thursday the 18th, as part of this survey. We welcome a wide range of information from performers and others on issues such as being prevented from transferring or becoming independent, having a contract unilaterally renewed, or being restricted from using their stage names or photographs after transferring or becoming independent.

     The Trade Practices Research Office of the Trade Practices Department is in charge of this matter.
