The JFTC issued Cease and Desist Order and Surcharge Payment Order against Toys“R”Us-Japan, Ltd.

The Japan Fair Trade Commission (JFTC) today issued the cease and desist order, and the surcharge payment order against Toys”R”Us-Japan. Toys”R”Us-Japan returned the unsold goods to the Specific Suppliers,who were in bargaining positions inferior to it and reduced the amount equivalent to that of the discount by Toys”R”Us-Japan from the consideration to be paid to the Specific Suppliers,who were in bargaining positions inferior to it,unjustly in light of normal business practices. The total amount of the surcharge payment is 369.08 million yen.

Before issuing the cease and desist order,and surcharge payment order, the JFTC had given the enterprise in question an advance notification on the content of the order and an opportunity to present its view and to submit evidence. Considering the view and evidence from the enterprise, the JFTC issued the orders. The recipient dissatisfied with the order may request the JFTC to initiate a hearing regarding the order within sixty days of the date on which the transcript of the order was served.
