The JFTC Issued Cease and Desist Orders and Surcharge Payment Orders against Manufactures and Distributors of Expanded Poly-styrol Blocks

The Japan Fair Trade Commission (JFTC) today issued cease and desist orders and surcharge payment orders against enterprises engaged in manufacturing and distributing specified expanded poly-styrol blocks,which are used for various embankment purposes (hereinafter “EPS blocks”), since they substantially restrained competition in the field of trade of specified EPS blocks by, in concert with one another,appointing the designated successful bidders and managing to have the designated successful bidders win the orders from construction companies.

The total amount of the surcharge payment is 202.08 million yen.

Before issuing the cease and desist orders and surcharge payment orders, the JFTC had given the enterprises in question advance notifications on the contents of the orders and opportunities to present their views and to submit evidence. Considering the views and evidence submitted by them, the JFTC issued the orders. The recipients dissatisfied with the orders may request the JFTC to initiate a hearing regarding the orders within sixty days of the date on which the transcript of the orders were served.
