The JFTC Issued Cease and Desist Orders and Surcharge Payment Orders to Participants in Bidding for Low Temperature Air Conditioning System Works Ordered by JA in Hokkaido

The Japan Fair Trade Commission (JFTC) today issued the cease and desist orders and the surcharge payment orders to Narasaki Sangyo Co., Ltd. and Hokkaido Hitachi (hereinafter referred to as the “two companies”), finding that, at the latest by April 8, 2009, the two companies and Mitsubishi Electric Air Conditioning & Refrigeration Systems Co., Ltd., substantially restrained competition in the field of the low temperature air conditioning system works (Note) ordered by the agricultural cooperatives in Hokkaido prefecture by designating successful bidders and managing to have the designated successful bidders win the biddings. The total amount of the surcharge to be paid is 16.55 million yen.

Before issuing the cease and desist orders and the surcharge payment orders, the JFTC had notified the two companies of the contents of the proposed orders and provided them with opportunities to present their opinion and submit evidence. The JFTC issued the orders taking the opinion and the evidence submitted into consideration. A recipient dissatisfied with the JFTC orders may request, within sixty days of the date on which the transcript of the orders were served, the JFTC to initiate hearing procedures regarding the orders.

(Note) “Low temperature air conditioning system works” means the construction works for air conditioning systems used in facilities to store or precool agricultural products.
