Japan Fair Trade Commission
The Japan Fair Trade Commission (hereinafter referred to as the “JFTC”) today issued a warning to TOYOTA Mobility Tokyo Inc. (hereinafter referred to as “TMT”) as detailed in section 2 below.
In this case, the conduct of TMT was likely to be in violation of the provision of Article 19 (falling under paragraph (10) [Tie-in Sales, etc.] of Unfair Trade Practices) of the Antimonopoly Act (hereinafter referred to as the “Act”).
The JFTC also requested TOYOTA MOTOR CORPORATION (hereinafter referred to as “TMC”) and Japan Automobile Dealers Association (hereinafter referred to as “ADA”) to notify automobile dealers as detailed in section 3 below.

2. Summary of Warning
(1) a. TMT is suspected of having sold, tying the following services listed in (a) to (d) below, specific new cars manufactured by TMC, namely “Alphard”, “Vellfire” and “Land Cruiser” (hereinafter referred to as the “specified Toyota cars”) to prospective customers during the period from June 2023 at the latest to November 2024.(a) Body coating provided by TMT
(b) Maintenance package provided by TMT
(c) Conclusion of a credit agreement with TOYOTA FINANCE CORPORATION designated by TMT
(d) Trade-in arrangement with TMT
b. Around November 2024, TMT instructed employees engaged in specified Toyota cars’ sales operations not to engage in the conduct described in (1) a. above.
(2) The conduct of TMT mentioned in (1) a. above was likely to be in violation of the provision of Article 19 (falling under paragraph (10) [Tie-in Sales, etc.] of Unfair Trade Practices) of the Act. Therefore, the JFTC issued a warning to TMT not to engage in similar conduct in the future.
3. Requests to TMC and ADA
To prevent similar conduct from occurring at other automobile dealers, the JFTC requested that
(1) TMC notify its nationwide network of dealers that sell the specified Toyota cars, etc. of the details of this case and the need to comply with the Act, including the prohibition of tie-in sales; and
(2) ADA notify its member automobile dealers, etc., across the country of the same.
