JFTC surcharged participants in the bidding construction works called by Iwamizawa-city

The Japan Fair Trade Commission (JFTC) on 5 February, ordered 91 entrepreneurs to pay surcharge regarding the bid-riggings for construction works called by Iwamizawa City (Hokkaido Prefecture) based on Section 48-2(1) of the Antimonopoly Act.

1. Violations related to the surcharge (Recommendation: 30 January 2003, Decision: 11 March 2003)

(1) General Civil Engineering Works

Oikawa Sangyo K.K. and other 48 companies conspired to rig bids for the civil engineering works let by the Department of Construction, of Waterworks, and of Industrial Economy of Iwamizawa City, gardening works let by Department of Construction and of Industrial Economy with nomination of construction companies.

(2) Building Works

K.K. Katsui and other 43 entrepreneurs conspired to rig bids for the building works let by Department of Construction and of Industrial Economy of Iwamizawa City with nomination of construction companies.

(3) Tubing Works

Do-oh Kosan K.K. and other 16 companies conspired to rig bids for the tubing works let by Department of Construction and of Waterworks of Iwamizawa City with nomination of construction companies.

(4) Paving Works

Hokuritsu Hodo K.K. and other 15 companies conspired to rig bids for the civil engineering works let by Department of Construction and of Industrial Economy of Iwamizawa City with nomination of construction companies.

(5) Electrical works

Chiba Denki Koji K.K. and other 18 entrepreneurs conspired to rig bids for the electrical works let by Department of Construction and of Industrial Economy of Iwamizawa City with nomination of construction companies.

Every conduct of (1) - (5) above infringed Section 3 of the Antimonopoly Act (unreasonable restraint of trade) and pertains to the price of the services provided in Section 7-2 (1) of the Act.
