Japan Fair Trade Commission
The Japan Fair Trade Commission (JFTC) today approved the Commitment Plan submitted by LOPIA CO., LTD. (hereinafter referred to as “LOPIA”), including (i) not to engage in the same or similar conduct as the alleged conduct in this case, and (ii) to restore the monetary value for suppliers affected by the alleged conduct.
During the period from no later than around September 2022 until around June 2025, LOPIA required its suppliers, in connection with the opening of new stores and store reopenings following renovations, to dispatch their employees, etc. to the relevant stores, to carry out product display and shelf-stocking work for the stores, including work relating to products other than those supplied by the respective suppliers, without having reached prior agreement with those suppliers on the conditions for such dispatch, and without bearing the costs normally required for such dispatch.
It is noted that today’s approval of the Commitment Plan does not mean that LOPIA’s conduct violated the Antimonopoly Act.
